"In a little-publicized series of legal moves the past five weeks, regulators have reached settlements with six major home builders and one of the largest title insurers in the country. Under the settlement terms, the firms are scheduled to pay the government a total of $6.4 million, while denying they committed any illegal acts.

The largest settlement was announced the week before Thanksgiving. First American Title Insurance Co. agreed to shut down 84 "affiliated partnerships" formed in Florida with real estate brokers, mortgage brokers, banks and home builders. Federal and state investigators charged that while the affiliates claimed to be title companies, they were actually referral conduits that performed few, if any, title services. Officials said they existed primarily to steer lucrative title insurance business to First American, which split consumers' insurance premiums with participating "partners.""

These fines mean nothing to a multibillion-dollar criminal enterprise like First American Title.  Only criminal prosecutions will stop the destruction!

One of the chief architects of the destruction of Mike & Kay Dorrough's home and facility for the blind is Jonathan M. Hajny.  
This man uses his multiple positions within the bureaucracy to benefit cronies and to feather his own nest.

Why has it taken several years to find a photo of Dane County Insider Jon Hajny?  What does he have to hide?

Primary among the players in the Dorrough case was a Municipal Judge, Jonathan Hajny acting as opposing counsel representing the slippery property seller. He lied in a pre-trial hearing and used his multiple positions within Dane County's corrupt, elite circles to unlawfully achieve a default judgment on specious counterclaims.  Hajny is nothing more than a legal hack who had two unfair advantages in the early stages of the litigation between the Dorrough family and First American Title, et al.  First, was his personal, improper influence over crony, presiding Judge Higginbotham,

 and second, the ability to ride the coattails of First American Title's highly paid, ruthless legal team in the premeditated destruction of the Dorroughs. This unethical shyster also held a commissioner-level post within the same venue. He used that position to obtain Dorrough’s confidential and privileged communications with law enforcement officials as they desperately reached out for help regarding the theft of their land and even intimidation with firearms.   Those confidential, protected pleas for help were then twisted into fraudulent, perjurous  defamation counterclaims brought on behalf of Hajny's client, a well-connected local land speculator.  

Hajny also used his influence within the county zoning hierarchy to have Dorrough’s federally protected radio transmitting towers (meant to serve blind listeners) subjected to preliminary condemnation actions. This same individual also acted as a title agent aiding and abetting the seller to illegally squeeze three homes into a space where only one, or at most two residential structures could be built. This Attorney/Judge/Commissioner/Title Agent was involved in the deceptive and fraudulent land subdivisions and offerings from the outset. Hajny was the driving force behind the cover-up of the criminal conspiracy. He saw to it that Dorrough’s complaints about fraud, forgery and theft were ignored by the District Attorney and other levels of law enforcement.  Incompetent Circuit Court Judge Steven D. Ebert collaborated in that obstruction.

After Mike Dorrough was able to get some favorable local press coverage of his mission to bring radio to blind artists and audiences across North America, Hajny threatened the publisher of the town newspaper and then ghost-wrote a negative and defamatory retraction!

When Dorrough complained about the practices of the Judge/Commissioner/Title-Agent/Attorney behind the conspiracy to deny justice, it was discovered that this same individual’s wife worked on the board overseeing attorney rules and discipline! This 'power couple' has their fingers in many pies in Dane County, Stoughton and beyond!  The Hajny's self-serving public profile with various charitable organizations is ironic considering their treatment of advocates for blind and visually impaired people.  Their abuse of the courts in depriving tradesmen of their fees is particularly disgusting.  Power has its privileges!  

Thanks to Hajny and a culture of pervasive corruption, Dane County is worse than fictional backwater towns and counties depicted in Hollywood films. What makes Dane County MUCH WORSE however is that it is also the seat of STATE GOVERNMENT. Where real and fictional corrupt county officials had to be concerned about state authorities breaking up their profitable scams and conspiracies, Dane County and the State of Wisconsin are ONE AND THE SAME! With no checks and balances in place, only FEDERAL intervention will be able to clean house!

Jonathan Hajny committed the following unethical acts in the Dorrough litigation:

q    Intentionally and prematurely cut off communications between litigants to prevent any potential for an amicable resolution.

q   Knowingly soliciting and submitting to the court a false affidavit. 

q    Knowingly contradicting the basic thrust and technical content of the same affidavit with direct testimony elicited from the very same witness when it became expedient to change the direction of his client’s case strategy.

q    Intentionally violating ex-parte rules by feigning ignorance of the fact that Dorrough's second attorney had been discharged even though he had been directly notified by return-receipt mail.

q    Attorney continued to mail time-sensitive motions to long departed attorney resulting in an unjustified default and summary judgment that was temporarily reversed as part of a settlement deal.   Mailings to the opposing attorney from the new legal team were not “returned to sender” but intentionally returned to the long defunct, long unresponsive attorney.

q    During a pre-trial conference the attorney was asked directly by the presiding Judge if he had knowledge of the change in representation.  His unqualified “No” was a premeditated and highly injurious untruthful response.

q   Tampering through friendly Dane County official contacts.  There is a strong probability that the subject attorney directly caused Dane County officials to take unwarranted action (zoning violation) against Dorrough's property interests involved in the pending litigation.  Attorney mentioned the action in correspondence pre-dating our official notice from the county.   

q   Orchestrating the submission of injurious, false and defamatory “Letters to the Editor” for publication* regarding a case pending before the Dane County Circuit Court.  The tone of these letters was so inflammatory that they generated a danger of serious repercussions and even physical jeopardy for the Dorrough family within the local community.

THE CASE AGAINST FIRST AMERICAN! 

"Crimes committed against us by Santa Ana-based First American Title Insurance Company are part of a long pattern of unlawful conduct that we have repeatedly attempted to bring to the attention of law enforcement.  Here is a 5/2/07 article from the Santa Fe , New Mexican showing that a pattern of recidivist behavior on the part of this company is again a national story.  First American Title is thumbing its nose at state-based insurance commissions and apparently has no fear of federal law enforcement as they hide behind the McCarran-Ferguson Act (This law cedes regulation of the business of insurance to the states).  For the benefit of land purchasers across America , the Justice Department has an opportunity to rip away that shield by pursuing egregious RICO violations committed against us by First American.  

When forgery of title documents to facilitate land theft and development of a protected flood-plane is abetted by officials and local courts, standard state-based regulatory remedies will not suffice.  Most disturbing, this subversion of process has become standard operating procedure wherever First American Title finds big development and a weak state regulatory environment.  It is an interesting footnote that the one California Insurance Commissioner (Chuck Quackenbush) who aggressively pursued First American, was himself forced to resign.

There has been no response from law enforcement and regulators in Wisconsin and California to these compound felonies: 

      1- Wire-fraud across state lines from Wisconsin to the detriment of 
     California residents. 
2- Subversion of public officials & Judiciary.
3- Conspiracy / Document Tampering / Criminal Slander of Title.
4- Obstruction of Justice / Perjury.
5- Forgery facilitated by social security identifier.
6- Interference with a facility and persons serving a group protected
    by the ADA.

State level officials cannot cope with First American’s bottomless legal war chest and armies of attorneys.  None of the criminal aspects of our case have ever been investigated or lawfully adjudicated.  We are not able to occupy or sell the property.  We have never felt safe there due to an extremely hostile local environment created by agents of First American and their interlocking development partners.  Our essential civil rights as citizens have been denied due to the brute power and interstate reach of First American Corporation."

Marvin Ripp, Wisconsin Counsel, First American Title Insurance Company -  Forged the pivotal title document employing interstate wire-fraud to steal a key portion of our land in Oregon Wisconsin as part of a bait and switch scheme to sell an undersized lot.  He was legally and ethically bound to represent us (the buyer) but conspired with the seller to steal back land.  His serial lies prevented us from getting justice in court.

You have provided important documents relating to our ill-fated land purchase in the Town of Oregon .  Please note that you have sent two consecutive pages (V30981P-39 / 30981P-40) purporting to demonstrate that Lot #1 of CSM 7973 was submitted to your office and properly recorded on October 3, 1995.  While V30981P-39 shows a map depicting Lot #1 CSM 7973, the next sequential page V30981P-40 only NAMES Lot #2 CSM 7430.  As such it is sham, defective, intentionally deceptive and does NOT meet statutory requirements for legal recording.  Attached (PAGE 2) please find the certified survey map that matches the only lot referenced on V30981P-40 and the escrow document signed by all parties (PAGE 8).

 

These documents prove our point since this second page referring to Lot #2 - CSM 7430 is the only portion notarized, signed by you, the Oregon Town Clerk, the sellers and approved by Norbert Scribner.  In your letter you incorrectly stated that Norbert Scribner signed off on Lot #1 CSM 7973, when in fact he signed off ONLY on a page referencing Lot #2 CSM 7430, as reiterated in his subsequent finding. 

 

Ms Licht, please also notice the altered date on V30981P-40.  This alteration is part and parcel of an effort to deceive your clerk.  First American’s Marvin Ripp was not acting as Karen Dorrough’s authorized agent.  Contrary to your interpretation of forgery as innocent “goodwill” Ripp did not use the space on the Real Estate Transfer Return provided specifically for an “Agent”.  Mr. Ripp was specifically instructed not to file any correction deed until our own attorney could further investigate his so-called ‘error’ and any potential liability.  He was acting directly against our interests by fraudulently signing for Karen and by leaving Michael Dorrough out of the process altogether.    Your paperwork is direct evidence of crimes including forgery and fraud not only against us, but of a direct effort to defraud Dane County and the Register of Deeds.  Please help us to bring the perpetrator(s) to justice by requesting an immediate investigation by the District Attorney.

PLEASE RESPOND WITHIN 10-DAYS.

D.P. Kennedy, President, First American Title Insurance Company - A co-conspirator after, and BEFORE the fact, in 1995 Mr. Kennedy signed our title Insurance policy.  Used the full might of his company to subvert justice as his company worked against a policyholder in court.  

Here is the 3/17/98 writing of Norbert Scribner, stating in no uncertain terms that Certified Survey Map # 7973 was not legally recorded and that we purchased Lot 2 of Certified Survey Map # 7430. This writing would compel any reasonable person to appeal to public officials or to a court of law for remedies. This letter gave legal substance to the conclusion that we had been severely wronged.

Forged Title Transfer Document:  A blank version of this was faxed to Karen Dorrough in California.  When she refused to cooperate with a so-called ‘title correction’ this forged document was presented to Marvin Ripp’s secretary as if it had been faxed back with a signature.
